(Photo by Getty Images)<\/p>\n<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">A bill that would have made companies that sell digital downloads or streams of movies and video games <\/span><a href=\"https:\/\/azmirror.com\/briefs\/republican-proposal-would-tell-az-consumers-when-a-digital-purchase-isnt-really-a-purchase\/\"><span style=\"font-weight: 400\">disclose to customers that they\u2019re not purchasing permanent copies<\/span><\/a><span style=\"font-weight: 400\"> of that media was among the <\/span><a href=\"https:\/\/azmirror.com\/briefs\/katie-hobbs-adds-88-vetoes-to-her-record-rejecting-gop-bills-on-schools-wolves-and-elections\/\"><span style=\"font-weight: 400\">dozens of measures vetoed<\/span><\/a><span style=\"font-weight: 400\"> last week by Gov. Katie Hobbs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The bill by Rep. Nick Kupper, R-Surprise, would have seen Arizona follow California and mandate that companies disclose when consumers are obtaining a revocable license on digital goods as opposed to full ownership.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Kupper\u2019s <\/span><a href=\"https:\/\/apps.azleg.gov\/BillStatus\/BillOverview\/83543\" target=\"_blank\"><span style=\"font-weight: 400\">House Bill 2010<\/span><\/a><span style=\"font-weight: 400\"> would have made it illegal for a seller of a digital good to advertise that good using the terms \u201cbuy\u201d or \u201cpurchase\u201d if they do not inform consumers of restrictions on that purchase. Those restrictions include the possibility that the product could be altered or access to it could be revoked in the future.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Large companies like <\/span><a href=\"https:\/\/www.hollywoodreporter.com\/business\/business-news\/prime-video-lawsuit-movie-license-ownership-1236353127\/\" target=\"_blank\"><span style=\"font-weight: 400\">Amazon<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.thegamer.com\/playstation-removes-tv-shows-films-discovery-digital-media-no-refunds\/\" target=\"_blank\"><span style=\"font-weight: 400\">Sony<\/span><\/a><span style=\"font-weight: 400\"> have come under fire in recent years after consumers found that TV shows, movies and video games they purchased\u00a0 were removed from their digital libraries. Many consumers are unaware that when they \u201cbuy\u201d a digital movie or TV show they are really only purchasing a license agreement, which can later be revoked. That means consumers <\/span><a href=\"https:\/\/www.nytimes.com\/wirecutter\/blog\/you-dont-own-your-digital-movies\/\" target=\"_blank\"><span style=\"font-weight: 400\">don\u2019t really own much of the content they purchase<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Last year, California <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB2426\" target=\"_blank\"><span style=\"font-weight: 400\">passed a similar law<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Hobbs, <\/span><a href=\"https:\/\/mcusercontent.com\/44a5186aac69c13c570fca36a\/files\/7261af41-6f90-22f0-854e-a260c7ec47db\/HB2010_Veto_Letter.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">in her veto letter<\/span><\/a><span style=\"font-weight: 400\">, said that the bill was not clear enough.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe refund provisions of this legislation are ambiguous and inconsistent with other states,\u201d Hobbs said. \u201cI welcome legislation that provides notification standards and refund provisions that are implementable and clear.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Kupper said the veto caught him off guard, as the bill had near unanimous support throughout its legislative journey.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThat one surprised me. I&#8217;m not going to lie,\u201d Kupper said of the&#8217; veto, noting that the Governor\u2019s Office had never indicated it had problems with the legislation ahead of the veto.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The bill had unanimous support up until its final days of the legislative session when Democratic members in the House and Senate voted against it after a return to the Capitol after a long recess. Kupper cited <\/span><a href=\"https:\/\/www.phoenixnewtimes.com\/news\/arizona-lawmaker-sees-colleagues-baby-mentions-her-abortion-40671827\/\" target=\"_blank\"><span style=\"font-weight: 400\">comments he made online<\/span><\/a><span style=\"font-weight: 400\"> about Rep. Anna Abeytia, D-Phoenix, mentioning her previous abortion while commenting on a photo of the Democrat and her newborn baby, as the reason why Democrats switched positions on the bill.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cThe reason I believe, and I don\u2019t know this to be a fact on why the Democrats fell off at the end, was because of my comments on Anaya Abeytia,\u201d Kupper said, adding that he still votes in favor of bills he finds good policy, regardless of \u201cwhose name is on a bill.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">As for Hobbs\u2019 veto, Kupper said he doesn\u2019t entirely understand the governor\u2019s resistance, as he had worked with tech stakeholders like Apple to amend the bill in ways that made them more comfortable with the legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIt was almost exactly the law that California passed, and it was brought to me by a Libertarian,\u201d Kupper said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The measure also included a provision that says a seller must notify a consumer that the seller could modify the content, something that comes from Kupper\u2019s own experience when a digital good he purchased was altered after he paid for it.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In 2020, the creator of the TV comedy series \u201cThe Office\u201d <\/span><a href=\"https:\/\/deadline.com\/2020\/06\/the-office-blackface-scene-creator-greg-daniels-edits-2012-episode-1202971070\/\" target=\"_blank\"><span style=\"font-weight: 400\">deleted a scene<\/span><\/a><span style=\"font-weight: 400\"> that included a character who wore blackface. Kupper said he noticed when rewatching the episode that the scene was gone.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The bill would have required that a seller of digital goods provide a consumer with a list of the restrictions and conditions they are agreeing to under the license, a notice that the license may be altered from its original version and a notice that the license may be revoked. And it would have required that the statements must be clear and conspicuous.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Consumers would be asked to acknowledge that they understand these terms and conditions, which would be distinct from other terms and conditions that consumers are used to agreeing to online if the bill had been signed into law.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Any company that violated the disclosure could be investigated for violating the state\u2019s <\/span><a href=\"https:\/\/www.azleg.gov\/ars\/44\/01522.htm\" target=\"_blank\"><span style=\"font-weight: 400\">consumer fraud act<\/span><\/a><span style=\"font-weight: 400\">. Additionally, any consumer who is \u201caggrieved by a violation\u201d could bring a civil action to \u201crecover actual damages, reasonable attorney fees and court costs,\u201d and if the \u201cviolation is wilful or knowing,\u201d the court may award additional damages.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The bill did not apply to subscription-based streaming services, free services or educational goods provided by libraries or public institutions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">When asked if he intends to bring the legislation back next session, Kupper was quick to respond.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cOh, 100% yeah,\u201d he said.\u00a0 <\/span><\/p>\n<aside>        <a
