{"id":15253898,"date":"2026-08-13T23:05:44","date_gmt":"2026-08-14T03:05:44","guid":{"rendered":"https:\/\/www.inthacity.com\/news\/kris-mayes-targets-company-that-trapped-1500-arizona-homeowners-with-hidden-liens\/"},"modified":"2026-08-13T23:33:30","modified_gmt":"2026-08-14T03:33:30","slug":"kris-mayes-targets-company-that-trapped-1500-arizona-homeowners-with-hidden-liens","status":"publish","type":"post","link":"https:\/\/www.inthacity.com\/news\/kris-mayes-targets-company-that-trapped-1500-arizona-homeowners-with-hidden-liens\/","title":{"rendered":"Kris Mayes targets company that \u2018trapped\u2019 1,500 Arizona homeowners with hidden liens"},"content":{"rendered":"<figure><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/azmirror.com\/wp-content\/uploads\/2023\/09\/money-housing-coins-getty-1024x576.jpg\" class=\"attachment-large size-large wp-post-image\" alt=\"\" style=\"margin-bottom: 10px\" \/><figcaption>\n<p style=\"font-size:12px\">Photo via Getty Images<\/p>\n<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400\">Arizona Attorney General Kris Mayes is suing a real estate company that allegedly engaged in a predatory title scheme that defrauded approximately 1,500 Arizona residents, saying the company violated the state\u2019s consumer fraud act.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Non-Title Recorded Agreements for Personal Services, or NTRAPS, have been banned in multiple states because they use the promise of a quick sum of money \u2014 often less than $1,000 \u2014 to lock homeowners into a yearlong contract that they often don\u2019t understand until they try to sell their home.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">NTRAPS work by offering a homeowner a free market analysis of their home, which usually comes with a payment to the homeowner to show how serious the company is in the home. As soon as a homeowner signs, they get the money, the analysis and usually forget about the interaction.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">But that contract, which can run for up to 40 years, requires they use a specific company to list their home if they decide to sell it in the future. Failure to do so means they must pay the company 3% of the value of their home.\u00a0<\/span><\/p>\n<aside>        <a href=\"https:\/\/azmirror.com\/subscribe\" style=\"text-decoration:none\" aria-label=\"Get the morning headlines delivered to your inbox.\"><\/p>\n<div class=\"subscribeShortcodeContainer\">\n<div class=\"subscribeTextContainer\">\n                <i class=\"fas fa-envelope\"><\/i><\/p>\n<p>GET THE MORNING HEADLINES.<\/p>\n<\/p><\/div>\n<div class=\"subscribeButtonContainer\">\n<div>SUBSCRIBE<\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>        <\/a><br \/>\n        <\/aside>\n<p><span style=\"font-weight: 400\">Mayes is now suing one of the nation\u2019s largest companies behind NTRAPS, MV Realty, alleging that it violated the state\u2019s Consumer Fraud Act. The Arizona Mirror <\/span><a href=\"https:\/\/azmirror.com\/briefs\/some-1900-arizona-homeowners-have-fallen-for-a-predatory-title-scheme\/\"><span style=\"font-weight: 400\">first reported on these agreements<\/span><\/a><span style=\"font-weight: 400\"> in 2023, when legislation aimed at regulating them failed to gain momentum.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cMV Realty misled homeowners about the true nature of the Homeowner Benefit Program. Arizona homeowners who fell victim to MV Realty\u2019s deceptive sales practices were trapped by the liens placed on their homes and stripped of their hard-earned equity,\u201d Mayes said in a press release announcing <\/span><a href=\"https:\/\/mcusercontent.com\/cc1fad182b6d6f8b1e352e206\/files\/57cc759b-a4fc-7ed8-8198-ec3724475258\/2026_08_13_MV_Realty_Complaint_Final.pdf\" target=\"_blank\"><span style=\"font-weight: 400\">the lawsuit<\/span><\/a><span style=\"font-weight: 400\">. \u201cMy office will not allow predatory companies to take advantage of and profit from Arizona homeowners by making false promises.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">MV Realty did not immediately respond to a request for comment.<\/span><\/p>\n<p><span style=\"font-weight: 400\">MV Realty marketed NTRAPS as a \u201cHomeowner Benefit Program\u201d that it aggressively pushed on Arizona homeowners through robocalls and other telemarketing techniques that are also under scrutiny by Mayes\u2019 office.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/www.fcc.gov\/document\/fcc-warns-providers-about-robocalls-phoneburner-and-mv-realty\" target=\"_blank\"><span style=\"font-weight: 400\">FCC also has gone after MV Realty<\/span><\/a><span style=\"font-weight: 400\"> for using robocallers.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">MV Realty <\/span><a href=\"https:\/\/www.counton2.com\/news\/south-carolina-news\/mv-realty-files-for-bankruptcy-as-complaints-mount-over-40-year-listing-agreement\/\" target=\"_blank\"><span style=\"font-weight: 400\">filed for bankruptcy<\/span><\/a><span style=\"font-weight: 400\"> in 2023 amid multiple investigations by multiple state AGs.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Mayes\u2019 lawsuit alleges that MV Realty enticed 1,600 Arizonans to sign one of the agreements, with the majority of those homeowners receiving $1,000 for doing so.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The complaint says that the agreements specified that homeowners had to sell their house through MV Realty and pay either 6% of the sale price or 3% of what the company valued the home at time of signing. If a homeowner tried to terminate the contract early, the company would then demand an \u201cEarly Termination Fee\u201d equal to 3% of the home\u2019s value, which was determined by MV Realty.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cMV Realty incentivized volume enrollments by paying its sales agents a $500 commission for each HBA originated (rather than a salary) and used performance metrics to drive sign\u2011ups,\u201d the complaint says. \u201cDefendants typically withheld complete documents from homeowners until a notary arrived to execute the HBAs.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Most homeowners never saw the agreement until the notary arrived and then were not left with copies, according to the complaint.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The AG also found that MV Realty failed to \u201ccomply with Arizona\u2019s registration, bonding, and disclosure requirements for telephone solicitations.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">MV Realty\u2019s telemarketers used third-party data they purchased to call homeowners, wouldn\u2019t disclose the name of their company and encouraged them to join the \u201cHomeowner Benefit Program.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Mayes is asking the court to place a permanent injunction against the company from continuing the practice and is also seeking penalties of $10,000 per violation of the state\u2019s consumer protection act, as well as $1,000 for each violation of the National Do-Not-Call list.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">MV Realty\u2019s license to operate in Arizona expired at the start of this year after the company decided not to
